Oil Examination

The check is made in accordance to Article 36 of “Air Pollution Control Act”: ‘Manufacturing, importing, or selling fuels that are used by transportation vehicles should conform to the standards for composition and performance of the types of fuel established by the central competent authority.’

Underground oil vendors
Illegal refining or concocting fuel products
Unauthorized use of diesel intended for fishing boats (containing higher proportions of sulfur)
Diesel intended for fishing boats is much cheaper than ordinary diesel of the same grade, which tempts underground manufacturers and fishermen to draw out the diesel in fishing boats. The diesel is then shipped to oil tanks by using tankers or damaging the oil pipes and using them to convey the diesel to tanks. Then the diesel is sold to underground vendors. People misuse diesel intended for fishing boats and sell it to underground vendors, which can evade large amounts of tax. Moreover, this behavior damages public safety, severely pollutes air, increases car accidents, breaks market order of oil products, and breaches the privileges and rights of lawful business.

Control and punishments
According to Article 2, “Guideline Over the Permission and Management by The central competent authority of the Import, Export, Production, and Selling of Gasoline or Petroleum Products,” of the Bureau of Energy, Ministry of Economic Affairs, “The import, export, production, selling of gasoline or petroleum products must be permitted by the central competent authority before these businesses can be conducted.”
According to Article 64 of Air Pollution Control Act, Environmental Protection Administration of Executive Yuan, “Users that violated Article 36(1), 36(2), or the management guideline established according to (3), should be punished with a fine from NT 5,000 dollars up to 100,000; people that manufactured, sold, or imported those products should be punished with a fine from NT 100,000 dollars up to 1,000,000. A notice should be served to tell these people to improve within time limits. If the improvement is not done as required, a fine punishment should be levied on a daily basis.
